Insurance Law
Lecomte, Emanuelson & Doyle provides a full range of services to insurance carriers. With respect to coverage, Lecomte, Emanuelson & Doyle reviews coverage issues from the onset of the claim, provides coverage opinions and reservation of rights letters and, when necessary, takes affirmative steps to litigate the carrier’s coverage position.
We have successfully defended insurers in first party coverage and G.L ch. 93A claims at both trial and on appeal. For example, in Gelwan v. Vermont Mutual Insurance Company, Lecomte Emanuelson & Doyle tried a coverage / 93A claim in the United States District Court for the Southern District of New York. Coverage, damages and bad faith were all contested. Following a 13 day jury waived trial, the court entered judgment for the Plaintiff on the coverage claim, but, found in the insurer’s favor on the majority of damage claims and the bad faith claim. On appeal, the United States Court of Appeals for the Second Circuit, affirmed the district court’s ruling in the insurer’s favor on the bad faith claim. Most recently, we prevailed in a Declaratory Judgment action on behalf of Atain Specialty Insurance Company, Atain Specialty Insurance Company v. Davester, LLC., et. al., where we established that the carrier was under no duty to defend the insured bar, where the injured Plaintiff’s claims arose from or were related to the use of an automobile, a cause that was excluded under the policy.
Lecomte, Emanuelson & Doyle routinely represents insurers with respect to subrogation recovery actions in Massachusetts, Rhode Island and upstate New York. With respect to subrogation claims, we take a hands on approach and are involved in all aspects of the investigation from the onset of the claim. We evaluate the claim, consult with experts, send out notice, schedule and attend inspections, conduct settlement efforts, and, file suit and try, if necessary, the case. We have been involved significant multi-party subrogation claims in the Commonwealth, including the Uxbridge Mill fire (2007), the Danvers chemical fire (2006), and, most recently, the Merrimack Valley gas explosions (2018).
Finally, Lecomte, Emanuelson & Doyle provides insurers with liability defense services for the general liability claims, including, personal injury, product liability, fire claims and construction claims.
Probate Law
Lecomte, Emanuelson & Doyle represents individuals, trusts and estates in all aspects of probate practice, procedure and litigation. We can assist in filing a simple estate and routinely handle complex probate matters, including will contests and trust litigation. In conjunction with this probate practice, Lecomte, Emanuelson & Doyle offers estate planning services, including the preparation of wills and trusts. Generally, the probate practice intersects with our real estate practice, as most estates involve the sale of real property, and we are well suited to handle all aspects of the probate filings and real estate transactions. Recently, we represented an estate that was subject to two will contests. We were able to resolve the first challenge and obtain a dismissal, without the payment of any funds. With respect to the second challenge, we successfully moved to strike the objection, as it was not timely filed and lacked the requisite specificity to properly challenge a will. Once the challenges were dismissed, we were able to assist the personal representative to sell the property and close the estate.
